CALL TO ORDER: The Public Hearing of the Richland Township Planning Commission was called to order at 7:30 P.M. by Chairman Clark with the Pledge to the Flag.

PUBLIC HEARING: Chairman Clark stated the purpose of the Public Hearing is to consider a request for a special land use permit to allow recreational uses at 13375 Gratiot Road, parcel number 22-12-2-25-4005-000. Owners of the property are Kevin and Annette Lange. The property is zoned C-2 General Commercial. Notice of the Hearing was published in The Saginaw News and sent to neighboring properties as required. Comments were heard from: Sheila Bauer who stated heavy dust obstructed her vision when passing by the site; Joel Bauer stated he does not object to the Lange’s using the property for recreational use but is concerned for his families safety and well-being; Geraldine House questioned if a fence could be placed along the property line; Kevin Lange also is concerned with safety stating the site would be used two to three times a week for his family use only and is willing to make accommodations. Questions were raised by the Commission and answered by Mr. Lange and Mr. Bauer.

CLOSE PUBLIC HEARING: Motion by Walter Rohn, second by Brian Frederick, to close the Public Hearing. Unanimous vote. Public Hearing closed – 7:45 P.M.

CALL TO ORDER: Chairman Clark called the regular meeting of the Richland Township Planning Commission to order at 7:45 P.M.

MINUTES OF PREVIOUS MEETING: Motion by Brian Frederick, second by

Matt Bray, the Minutes of July 7, 2010 be approved and filed as printed. Unanimous vote. Motion carried.

INSPECTION REPORT: Motion by Brian Frederick, second by Walter Rohn, to receive and file the Inspection Report for the month of July/August 2010. Unanimous vote. Motion carried.

ZONING ADMINISTRATORS REPORT: Zoning Administrator Rames stated letters have been sent regarding unlicensed vehicles; working on inventory of non-conforming use; reviewed site plan for METC; contacted R & R Ready Mix regarding lack of plantings that were required on original site plan; also, letters were sent to two residences on Tittabawassee Road concerning dog kennels.

PUBLIC COMMENT: None.

OLD BUSINESS:

FUTURE LAND USE MAP: The future land use map was submitted as approved by the Richland Township Board of Trustees. Motion by Brian Frederick, second by Matt Bray, authorizing Zoning Administrator Rames to proceed with the next step to amend the future land use map by sending letters of intent to those as required by the Ordinance. Unanimous vote. Motion carried.

NEW BUSINESS:

SPECIAL LAND USE PERMIT: Motion by Brian Frederick, second by Walter Rohn, to grant the Special Land Use Permit to Kevin and Annette Lange, to allow recreational uses at 13375 Gratiot Road with the following conditions: 1) the property will be used for recreational uses by only the immediate family; 2) the hours the parcel can be used for recreational purposes are from 9:00 a.m. to 9:00 p.m.; 3) the portion of the property adjacent to the parcel (east side) owned by Joel and Mindy Bauer will have a five (5) foot solid fence along the side of the house and back yard, the five (5) foot fence shall not be closer to the road right of way than twenty (20) feet; 4) the tracks and jumps will be erected at least fifty (50) feet from the property lines. Unanimous vote. Motion carried.

PUBLIC COMMENT: None.

ADJOURNMENT: Motion by Brian Frederick, second by Matt Bray, to adjourn. Unanimous vote. Meeting adjourned – 8:25 P.M.
