Admin. CALL TO ORDER: Chairman Clark called the regular meeting of the Richland Township Planning Commission to order at 7:30 P.M. with the Pledge to the Flag. MINUTES OF PREVIOUS MEETING: Motion by Bernard Neuenfeldt, second by David King, the Minutes of February 1, 2011 be approved and filed as printed. Unanimous vote. Motion carried. INSPECTION REPORT: Motion by Brian Frederick, second by Bernard Neuenfeldt, the Inspection Report for January 2011 be approved and filed as printed. Unanimous vote. Motion carried. Motion by David King, second by Brian Frederick, the Inspection Report for February 2011 be approved and filed as printed. Unanimous vote. Motion carried. ZONING ADMINISTRATORS REPORT: Zoning Administrator Rames stated he reviewed the proposed site plan submitted by Karen Graves for a pond larger than one acre; continuing with inventory of non-conforming uses; sign approval for Graves and sent out letters requesting sign applications; approved site plan for a Pond clean-out on Fehn Road; worked on notices for a rezoning request for Saginaw Auto Polish; also verbal communications with Mr. Jim Higgins regarding the Zoning Board of Appeals decision. PUBLIC COMMENT: Comments regarding the Special Use Permit for the Graves pond were heard. OLD BUSINESS: POND LARGER THAN ONE ACRE: The applicant is Karen Graves, 17350 Ederer Road, parcel number 22-12-2-32-4004-000. The property is zoned A-2, Agricultural Dispersed Residential. The application and site plan were reviewed. The proposed excavation is 10 acres, with the edge of the excavation at least 50 feet from all property lines. The deepest part of the excavation is 30 feet. The parcel size is 21.96 acres. Review of the Special Use Permit was brought to the table regarding a request that was received from Wilcox Professional Services on behalf of Karen Graves to issue approval for excavation and removal of sand from the property with limitations that were addressed by Wilcox. Motion by Bernard Neuenfeldt, second by David King, to grant the Special Use Permit for the 10 acre pond as submitted by Karen Graves, 17350 Ederer Road, parcel number 22-12-2-32-4004-000, with the following stipulations: receipt of the permit from the State of Michigan Department of Natural Resources & Environment (DNRE) Water Resources Division; receipt of the permit from the Saginaw County DPW Soil Erosion Office; all work is to be conducted between the hours of 8 a.m. and 6 p.m.; pay the fee as set by the Richland Township Board, Resolution 2008-08, for hauling of extracted soils on roads in Richland Township; contractor is to utilize whatever method that best reduces excessive noise and dust created by the project; contractor observes all frost requirements and insure cleanup of material spillage upon the roadway as required by the Law; Also, to grant permission to begin excavation and removal (off-site transportation) of sand from the property under the following limitations: excavation is limited to existing uplands; excavation is limited to areas above the estimated seasonal high water table (approximate elevation 661.5); excavation in wetlands or below the estimated seasonal high water table will not be allowed unless a permit is issued by the DNRE; contractor to follow the same requirements identified for work hours, payment fees, noise and dust control and observance of spillage, cleanup on roadways as required by Law. Unanimous vote. Motion carried. NEW BUSINESS: None. PUBLIC COMMENT: Karen Graves and Russ Eggers thanked the Commission for granting the Special Use Request.
